Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier,

who have taken possession of the goods or has taken possession of the goods (in the case of a sales contract for goods);
have taken possession of the last goods or has taken possession of the last goods (in the case of a contract for several goods ordered as a single order and delivered separately);
taken possession of the last part delivery or the last piece (in the case of a contract for the delivery of goods in several part deliveries or pieces);
have taken possession of the first goods, or have had possession of the first goods (in the case of a contract for the regular delivery of goods over a specified period).

To exercise your right of withdrawal, you must inform us (Thermowhite GmbH, Pyhrn 3, 4582 Spital am Pyhrn, Austria, Tel.: +43 7563 21811, E-Mail: office@thermowhite.at) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an e-mail).

You can use the attached sample cancellation form for this, although it is not mandatory.

To comply with the withdrawal period, it is sufficient to send the notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal (cancellation)

If you revoke this contract, we shall reimburse you for all payments we have received from you, including the cost of delivery (with the exception of any additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive notice of your revocation of this contract.

For this refund, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you; in no case will you be charged any fees for this refund.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.

You have to send back or hand over the goods to us (Thermowhite GmbH, Pyhrn 3, 4582 Spital am Pyhrn, Austria) without delay and in any case at the latest within fourteen days from the day on which you inform us of the cancellation of this contract. The time limit is met if you send the goods before the expiry of the fourteen-day period.

You bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods if this diminished value is due to handling of the goods that was not necessary for examining their condition, properties, and functionality.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to contracts:

for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
for the supply of goods which are liable to rapid deterioration or are likely to become stale quickly;
for the delivery of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which can only be delivered at the earliest 30 days after the conclusion of the contract, and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;
for the delivery of newspapers, magazines, or periodicals, with the exception of subscription agreements.

The right of withdrawal expires prematurely for contracts:

for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery;
for the delivery of goods when, after delivery, they have become inseparably mixed with other goods by reason of their nature;
for the delivery of audio or video recordings or computer software in a sealed package, if the seal has been broken after delivery.
